Privacy Policy

Last updated: May 28, 2026 · Data controller: Vibe Software Solutions, Inc.

HYVE is local-first software. The desktop application runs on your machine and stores your projects locally. Credentials you give it (SFTP/FTP, MySQL, FXServer RCON, txAdmin token) are used by a local agent on your machine and are never transmitted to our servers.

The data we hold about you is limited to: (a) what you submit when purchasing Founders Beta Access via Stripe; (b) what you send by email; (c) standard web-server access logs of hyverp.com.

1. Who we are

Vibe Software Solutions, Inc. ("we", "us") operates HYVE and the website hyverp.com. We are the data controller for personal data covered by this policy.

Contact: Majixx@vibesoftwaresolutions.com for privacy questions, data subject requests (access, deletion, portability), or to exercise any right described below.

2. What data we collect

2.1 When you purchase Founders Beta Access

Stripe processes your purchase on our behalf and collects:

  • Email address
  • Name (as it appears on your payment method)
  • Billing address (for tax compliance)
  • Payment card data (Stripe handles this; we never see your full card number)
  • IP address (logged by Stripe for fraud prevention)

From Stripe we receive: your email, name, billing address, the fact of your successful payment, and an order ID. We do not receive your card data. Stripe is the data processor for payment information; their privacy policy at stripe.com/privacy governs that data.

Lawful basis (GDPR): performance of a contract (Article 6(1)(b)) — we need this data to deliver the Founders Beta Access you bought.

2.2 When you email support

We hold the contents of your email, your email address, and any attachments you choose to send.

Lawful basis (GDPR): legitimate interest in handling your support request, or contract performance if your request relates to your Founders purchase.

2.3 When you visit hyverp.com

Our web server logs standard access information: your IP address, the page requested, your user-agent (browser/OS), the referring URL, and a timestamp. These logs are used to diagnose technical issues and to detect abuse. We do not use these logs for advertising or tracking.

The site uses Google Fonts (loaded via fonts.googleapis.com), which exposes your IP address to Google during the font load. We do not embed any other third-party scripts, analytics, or trackers. We do not use cookies on the marketing pages. The localStorage entries the site writes (e.g. hyve.founders.ack) are stored only in your browser and are not transmitted to us.

2.4 What the HYVE Software (desktop) stores locally on YOUR machine

The HYVE desktop application stores your projects, content, and configurations on your local filesystem. The local backend agent caches credentials you give it (SFTP password, MySQL password, txAdmin token, RCON password) only in memory for the duration of an active operation, plus your Anthropic API key as an environment variable you set yourself.

None of this data is transmitted to Vibe Software Solutions, Inc. It is your data, on your machine, under your control.

When you use HYVE's AI features, your prompts are sent to Anthropic (the LLM provider) using your own API key. Anthropic's privacy policy governs that interaction.

3. How we use your data

  • To deliver Founders Beta Access — we use your email to send your receipt, delivery notification (around Nov 1, 2026), and material update announcements.
  • To provide support — we read and reply to your support emails.
  • To comply with law — we retain transaction records as required by tax and accounting law (typically 7 years in the US; this varies by jurisdiction).
  • To prevent fraud — Stripe analyzes purchase patterns to detect chargeback fraud; this is a contractual feature of our payment processor.

We do not sell your data, use it for advertising, share it with third parties for marketing, or train AI on your prompts or projects.

4. Data retention

  • Purchase records: retained for 7 years after purchase (or longer if required by tax law in your jurisdiction).
  • Support email threads: retained for 3 years after the last interaction.
  • Web-server access logs: retained for 90 days, then automatically deleted.

5. Data sharing

We share data only with the processors needed to deliver and support HYVE:

  • Stripe Payments Inc. — payment processing (DPA in place via Stripe's standard terms);
  • Our email provider (current provider: TBD; will be published here before public launch) — for transactional emails;
  • Anthropic — only if you use HYVE's AI features and only with your own API key; HYVE itself does not relay your prompts through our servers.

We may also disclose data when required by law (court order, lawful government request, fraud prevention).

6. Your rights

Subject to applicable law (GDPR for EEA/UK residents, CCPA/CPRA for California residents, similar regimes elsewhere), you have rights including:

  • Access — request a copy of the data we hold about you.
  • Correction — request that we correct inaccurate data.
  • Deletion — request erasure of your data, subject to our legal retention obligations.
  • Portability — receive your data in a machine-readable format.
  • Objection — object to processing based on legitimate interest.
  • Withdraw consent — where processing is based on consent (you may still receive transactional emails required to deliver your purchase).

To exercise any right, email Majixx@vibesoftwaresolutions.com. We respond within 30 days. You also have the right to lodge a complaint with your supervisory authority.

7. International transfers

Vibe Software Solutions, Inc. operates from North Carolina, USA. If you are in the EEA, UK, or another jurisdiction with cross-border transfer rules, your data may be transferred to and processed in the United States, which may have different data-protection laws. Where required, we rely on Standard Contractual Clauses or other lawful transfer mechanisms.

8. Children

HYVE is not intended for users under the age of 16. We do not knowingly collect data from children. If we learn that we have, we will delete it.

9. Security

We use industry-standard safeguards (encryption in transit via TLS, access controls, principle of least privilege) for data we hold. However, no system is perfectly secure. Stripe operates the payment-data systems and is PCI-DSS certified. For details on HYVE's software-level security model (the desktop + local agent), see the public SECURITY.md in the HYVE repository.

10. Changes

We may update this Privacy Policy. Material changes will be communicated to your email of record if you have a Founders account. The "Last updated" date at the top of this page reflects the current version.

This document is provided as a starting point and is not legal advice. Before relying on this Privacy Policy for public sales, have it reviewed by qualified counsel in the jurisdictions where you operate. Several specific values (registered office address, exact email-service provider) are intentionally marked TBD until you finalize them.
