Refund Policy

1. Why "no refunds"?

Founders Beta Access is a pre-sale priced at less than half of the standard $750/year license rate ($350 once vs $750/year recurring). The discount and lifetime-update grant are contingent on your commitment now to fund development to the November 1, 2026 delivery. We cannot honor that pricing structure while also offering refunds — the entire purpose of the pre-sale is to enable Vibe Software Solutions, Inc. to commit to a delivery date with funded capacity.

2. What this means specifically

• We do not issue refunds for any reason, including but not limited to: change of mind, financial hardship, dissatisfaction with the product, project cancellation, business closure, technical incompatibility with your environment, or delays in the November 1, 2026 delivery of up to 90 days.
• We do not pro-rate or partial-refund based on time elapsed.
• We do not transfer Founders licenses between individuals after purchase.

3. What you got in exchange

• A one-time payment of $350 vs an alternative of $750/year recurring — i.e. you save $400 in the first year alone, then save $750/year for every subsequent year you would have remained a customer;
• Lifetime Updates — all future patches, minor versions, and major versions of HYVE for as long as HYVE remains in active development by Vibe Software Solutions, Inc.;
• Founders-only Discord access and roadmap input;
• Locked-in price — your license never re-bills.

4. Statutory protections we cannot waive

In certain jurisdictions, consumer protection law provides remedies that cannot be waived by contract. If you reside in such a jurisdiction:

• European Union / UK: Article 16(m) of the EU Consumer Rights Directive 2011/83/EU explicitly permits waiver of the right of withdrawal for digital content provided the consumer is informed and consents. Our checkout flow secures that informed consent via the acknowledgment checkbox and Stripe's secure checkout page. We rely on this provision.
• Australia: The Australian Consumer Law guarantees that goods be of acceptable quality, fit for purpose, and match their description. These guarantees are not waivable. If HYVE materially fails to match its description, you may have a statutory remedy regardless of this policy.
• Quebec / certain US states: Local law may grant specific non-waivable remedies. We comply with the statutory minimum where applicable, but in no case will we issue refunds beyond what is statutorily required.

5. Chargebacks

If you initiate a chargeback after a successful purchase, we will respond to the dispute with our records: the Stripe checkout session, the acknowledgment checkbox event, our Terms of Service, this Refund Policy, and the product description you saw before paying. Initiating a chargeback for the purpose of bypassing this policy is contrary to your card-network terms and may result in legal action by Vibe Software Solutions, Inc. to recover the disputed funds plus fees.

6. Delivery problems

If you do not receive your beta delivery email on or around November 1, 2026, contact Majixx@vibesoftwaresolutions.com. Delivery failures (e.g. lost email, account error on our side) are not refunds — they are operational issues we will fix by re-sending the delivery via an alternate channel.

7. The Standard plan (post-Feb 2027)

The Standard licensing plan ($750/year, available from February 1, 2027) will be sold under its own terms current at the time of sale. The Standard plan's refund policy may differ from this Founders policy. This document governs Founders pre-sale purchases only.
