By purchasing, downloading, or using HYVE, you agree to these Terms. If you do not agree, do not purchase, download, or use HYVE.
These Terms of Service form a binding agreement between Vibe Software Solutions, Inc. and you, the user ("you", "Founder", or "Licensee"). The agreement covers your purchase of HYVE Founders Beta Access, your use of the Software, and your access to associated services (Discord channel, support email).
A one-time, non-refundable license to HYVE Founders Beta Access for a one-time payment of USD $350. Your purchase grants:
The beta build will be made available to all Founders on or about November 1, 2026. We may delay or accelerate delivery based on development progress; we will communicate any change of more than 14 days to your email of record.
The Founders pre-sale window opens on May 28, 2026, and closes on November 1, 2026 at 23:59:59 UTC — the same day beta access ships. After November 1, 2026, the Founders one-time pricing is permanently discontinued. HYVE then enters a closed beta period in which no new licenses are sold to the public. Standard licensing ($750/year, terms current at time of sale) opens on February 1, 2027.
NO REFUNDS WILL BE ISSUED ON FOUNDERS BETA ACCESS.
By completing your purchase, you explicitly acknowledge and agree:
The clear and conspicuous disclosure of these terms before you completed your purchase, together with your affirmative acknowledgment via the checkbox on hyverp.com and your decision to complete checkout on Stripe's hosted checkout page, constitute your express and informed consent.
"Lifetime" refers to the active commercial lifetime of HYVE as a product offered by Vibe Software Solutions, Inc., not your lifetime. If Vibe ceases active development of HYVE, Founders retain a perpetual license to use the last version delivered to them, but no new updates will be issued. There is no server-side license check that disables the Software upon discontinuation.
Lifetime Updates includes patches, minor versions, and major versions of the HYVE software itself. It does not include:
HYVE's AI Editors — including the AI Architect, AI Script Generator, Gameplay place-by-prompt, Photo→Character, AI Interior Decoration, and any other AI-assisted feature — are powered by the Anthropic API. To use them you must supply your own Anthropic API key, which you purchase separately from Anthropic at console.anthropic.com.
As a Founder, you may receive optional early access to a pre-release "alpha" build of HYVE before the November 1, 2026 beta delivery. The alpha is provided as an additional courtesy to Founders who wish to help test and harden the software. It is not the product you are purchasing, and access to it is not a condition of your purchase. By accessing or using any alpha build, you acknowledge and agree:
Subject to your continued compliance with these Terms, Vibe grants you a non-exclusive, non-transferable, non-sublicensable license to install and use HYVE on machines you own or control, for the purpose of designing, generating, and operating FiveM roleplay server content.
HYVE and all associated materials (source code, brand assets, prompts, system prompts, documentation) are and remain the property of Vibe Software Solutions, Inc. These Terms grant a license, not a sale, of the Software.
Content you generate with HYVE belongs to you. You may use, modify, distribute, and sell content generated through HYVE, subject to the restrictions in Section 3.2 and any applicable third-party licenses (e.g. QBCore is licensed GPLv3 by its respective authors; content you build on top of QBCore may inherit GPLv3 obligations).
HYVE lets you import, edit, reference, and build alongside files and resources that you provide — for example existing server resources, vehicle and handling metadata, map images, and add-on packs. You are solely responsible for ensuring that you own, or are properly licensed to use, any such third-party assets, resources, scripts, maps, or content, and for complying with the terms under which you obtained them. HYVE grants you no rights in any third-party asset; it does not host or redistribute third-party assets; and it never decrypts or circumvents technical protection measures, including Cfx asset escrow. Where you supply an escrowed or otherwise protected resource, HYVE works only with its open, user-accessible files and never with its encrypted contents.
HYVE interoperates with independent third-party projects and frameworks — including QBCore and Qbox (licensed GPLv3), ESX, ox_lib, oxmysql, PolyZone, and others — each governed by its own license. HYVE does not distribute the source code of these projects. Content you generate that targets, depends on, or builds upon a third-party framework may be subject to that framework's license (for example, GPLv3), and you are responsible for complying with those licenses. We recommend reviewing each framework's license for your intended use.
HYVE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. Vibe makes no warranty that HYVE will meet your requirements, operate without error, or be compatible with future versions of FiveM, FXServer, QBCore, Qbox, or any third-party tool.
HYVE is not affiliated with, endorsed by, or sponsored by Rockstar Games, Take-Two Interactive, Cfx.re, FiveM, or any framework author. "GTA" and "Grand Theft Auto" are trademarks of their respective owners; HYVE uses only original branding.
Content generated by HYVE — Lua resources, SQL, configuration, designs, and AI-assisted output — is provided AS IS, may contain errors or insecure patterns, and is not guaranteed to be complete, secure, bug-free, or fit for any particular purpose. You are responsible for reviewing, testing, and securing all generated output before deploying it to a live server. HYVE's analyzers, validators, and "Doctor" surface common issues but do not guarantee that your server is secure, error-free, or compliant.
The optional AI Editors operate using your own Anthropic API key and are subject to Anthropic's terms. AI-generated output may be inaccurate, may not reflect current FiveM or framework APIs, and may resemble pre-existing works; you are responsible for reviewing it. HYVE does not warrant AI output and is not responsible for usage charges billed to you by Anthropic.
FiveM, Cfx.re, Rockstar Games, Grand Theft Auto, GTA, Take-Two Interactive, QBCore, Qbox, ESX, Tebex, Discord, Anthropic, and all related names, logos, and marks are the property of their respective owners. HYVE references them only nominatively, to describe compatibility and interoperability, and uses only its own original branding. No affiliation, sponsorship, or endorsement is claimed or implied.
HYVE's documentation, tutorials, in-app guidance, security and performance warnings, and any compatibility or compliance suggestions are provided for general informational purposes only and do not constitute legal, financial, or other professional advice. You are responsible for confirming your own compliance with all applicable laws, platform terms (including the Cfx.re Creator Platform License Agreement), and third-party licenses.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBE'S AGGREGATE LIABILITY UNDER THESE TERMS, FOR ANY CLAIMS OF ANY KIND ARISING FROM OR RELATED TO HYVE, SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR YOUR FOUNDERS BETA ACCESS LICENSE, OR (B) USD $350. IN NO EVENT WILL VIBE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify and hold harmless Vibe Software Solutions, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (i) your use of HYVE in violation of these Terms; (ii) content you generate, distribute, or sell that infringes third-party rights; or (iii) your violation of any applicable law.
We may terminate your license if you materially breach these Terms. Upon termination, your right to use HYVE ends; however, Founders' one-time license fee is not refundable (see Section 2.4). You may stop using HYVE at any time by uninstalling it.
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws principles, and apply to users in all fifty (50) states of the United States. Any dispute arising out of or relating to these Terms or HYVE shall be resolved exclusively in the state and federal courts located in North Carolina, and you irrevocably consent to the personal jurisdiction and venue of those courts regardless of the state in which you reside.
If you reside in the European Union, the United Kingdom, Australia, or Quebec, you may have additional consumer protection rights under your local law that cannot be waived. Nothing in these Terms limits or excludes any such mandatory rights.
We may update these Terms from time to time. Material changes affecting Founders (e.g. changes to the scope of Lifetime Updates) will be communicated to your email of record at least 30 days before they take effect. Continued use of HYVE after the effective date constitutes acceptance.
